THE CORPORATION OF THE
BY-LAW NO. 15-06
Being a by-law to request payment of any taxes and
penalties owing prior to development of a property.
WHEREAS the Municipal Act, S.O. 2001, c.25, Section 8, a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority,
WHEREAS the Municipal Act, S.O. 2001, c.25, Section 9(1), enables municipalities to govern their affairs as they consider appropriate,
WHEREAS the Municipal Act, S.O. 2001, c.25, Section 9(3)(b), a by-law may require persons to do things respecting the matter and impose conditions as a requirement of obtaining, continuing to hold or renewing a licence, permit, approval or registration,
WHEREAS the Municipal Act, S.O., 2001, c.25, Section 10(1), a by-law may be general or specific in its application and may differentiate in any way and on any basis a municipality considers appropriate,
NOW THEREFORE the Council of the Corporation of the Township of Machar request payment of any and all taxes and penalties owing prior to any development of a property, including, but not limited to, the following:
1) prior to the application and issuance of a building permit,
2) prior to the review and consideration of a severance application,
3) prior to the acceptance of an application to purchase lakeshore road allowance,
4) prior to the application and inspection for a trailer location,
5) prior to the review and consideration of a rezoning application,
6) prior to the review and consideration of a minor variance application.

THIS BY-LAW enacted this 28th day of August 2006. By-Law No. 17-04 is hereby repealed.
