THE CORPORATION OF THE TOWNSHIP OF MACHAR

BY-LAW NO. 21-11

Being a by-law to implement Landfill disposal fees.

 

 

WHEREAS the Municipal Act S.O.2001, c.25, s. 11(1)3. authorizes a single tier municipality to pass by-laws respecting matters within the waste management sphere of jurisdiction;

 

WHEREAS the Municipal Act S.O.2001, c.25, s.391(1)(a) and (c) authorizes a municipality to pass by-laws imposing fees or charges on any class of persons for services or activities provided or done by or on behalf of it and for the use of its property including property under its control;

 

WHEREAS the Municipal Act S.O.2001, c.25, s.396(1)(c), (d) and (e) authorizes such a by-law to provide for fees and charges that vary on any basis the municipality or local board considers appropriate and specifies in the by-law, including the level or frequency of the service or activity provided or done, the time of day or of year the service or activity is provided and whether the class of persons paying the fee or charge are residents or non-residents of the municipality, different classes of persons and deal with each class in a different way, and the exemption, in whole or in part, of any class of persons from all or any part of the by-law;

 

AND WHEREAS the Corporation of the Township of Machar (the “Township”) wishes to change the fees which it imposes for the use of its waste management landfill facility;

 

AND WHEREAS the Township has complied with the public meeting, notice and information requirements as provided for in Section 12 of Ontario Regulation 244/02;

 

AND WHEREAS Council of the Township has determined and is satisfied that the amount of fees imposed pursuant to this by-law for the use of the Township’s waste management landfill facility do not exceed the cost of providing the facility;

 

NOW THEREFORE THE CORPORATION OF THE TOWNSHIP OF MACHAR HEREBY ENACTS AS FOLLOWS:

 

  1. Waste disposal fees are hereby imposed upon those persons using the Township’s waste management landfill facility in accordance with the Schedule of Fees attached hereto as Schedule “A”.

 

  1. All fees imposed pursuant to this by-law are payable at the facility at the time of the disposal of the waste unless prior arrangements have been made in writing with the Township permitting payment of the fees on a periodic basis when invoiced.

 

  1. Interest shall be due and payable at the rate of 15% per annum on any fee imposed pursuant to this by-law that is due and unpaid.

 

  1. The fees imposed by this by-law shall be effective upon enactment and supercede any previous fees imposed.

 

  1. This by-law shall remain in full force and effect until December 31, 2012, unless otherwise amended by by-law prior thereto.

 

THIS by-law read a first, second and third time and finally enacted this 24th day of May 2011.

SCHEDULE “A” to By-Law No. ­­_______

 

MACHAR TOWNSHIP LANDFILL DISPOSAL FEES

 

Buried or Burned Waste

(Base formula:  $5.00 per cu yd uncompacted/$20.00 per cu yd compacted)

 

            Residential Waste (including Brush over 3 cu yds)

                        Half Ton Truck or Trailer                                $15.00 = discharge

 

            Construction/Commercial/Industrial Waste (including Brush)

            Based on formula:  $5.00 per cu yd uncompacted/$20.00 per cu yd compacted

                        Example:  single axle dump truck                    5 yd x $5.00 cu yd = $25.00

                                         tandem axle dump truck                            12 yd x $5.00 cu yd = $60.00

                                         half ton pickup or trailer                  3 yd x $5.00 cu yd = $15.00

 

            Contaminated Waste/Soil                                           $325.00 per load

 

Volumes will be determined by the landfill site attendant prior to discharge. 

UNSORTED LOADS WILL BE CHARGED DOUBLE FEE.

 

 

Furniture, mattresses, etc.                                             $5.00 per item

Appliances and refrigeration units tagged                    $5.00 per item

Refrigeration Appliances Untagged                           $25.00 per item

 

Tires on rims - NOT ACCEPTED

 

Household Hazardous Waste must be deposited at Hazmat Site in Strong Township Landfill.

                                                                                                                                                  Volumes will be determined by the Landfill Site Attendant prior to discharge.

 

 

Non Township of Machar residents;

 

$160.00 annually per household/business/facility plus disposal fees, recycling is mandatory.

 

  $30.00 annually per household/business/facility to recycle only, where recycling program                                                                                        not available.
